Terms of Service

Your Agreement
This is a binding agreement between Streamhand LLC ("Streamhand," "we," "us," or "our"), a video streaming service provider, and you as an individual (collectively, "you"). The following terms and conditions, together with any documents they expressly incorporate by reference (collectively, the "Agreement" or "Terms of Service"), govern your access to and use of https://thestreamhand.com, the Streamhand mobile application, and any of Streamhand's other websites or applications that directly link to these Terms of Service (collectively, the "Service").
Please read these Terms of Service carefully before you start to use the Service. By using the Service or by clicking to agree to these Terms of Service when this option is made available to you, you accept and agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree to these Terms of Service or the Privacy Policy, you must not access or use the Service.
1. Accounts
1.1 Registration
To access certain features of the Service, you must create an account ("Account") by providing registration details such as your name and email address. You may only create one Account per email address. It is a condition of your use of the Service that all information you provide is correct, current, and complete. You agree that all information you provide is governed by our Privacy Policy.
1.2 Eligibility
You must be at least 13 years old to create an Account or use the Service. If you are under 18, you may only use the Service with the involvement and consent of a parent or legal guardian, who agrees to be bound by these Terms of Service. If you are a parent or guardian allowing a minor to use the Service, you are responsible for all activity under that Account.
1.3 Account Security
You are responsible for maintaining the confidentiality of your Account credentials and for all activities that occur under your Account. You should contact us immediately at support@thestreamhand.com if you believe your Account has been compromised. We are not responsible for any unauthorized access to or use of your Account.
2. The Service
Streamhand provides a live video streaming platform that includes:
- Cloud Restreaming: Accepts a single incoming RTMP or SRT stream and forwards it to multiple output destinations simultaneously.
- Mobile App: An iOS and Android application that connects to Meta AI glasses (via Meta's Wearables Device Access Toolkit) and streams to RTMP/SRT endpoints, including Streamhand's cloud service.
- Disconnect Protection: Automatically switches to user-configured fallback media when a live stream drops and switches back when the stream resumes.
We may offer both free and paid tiers of the Service ("Free Services" and "Paid Services," collectively "Services"). We may, at our sole discretion, change which features are available in free or paid tiers, add new features, or discontinue features at any time.
3. Beta and Early Access
The Service, including the mobile app, is currently available through beta and early access programs. During this period:
- The Service may contain bugs, errors, or incomplete features.
- Features may change or be removed without notice.
- We may reset accounts or data if necessary for technical reasons, with advance notice where possible.
- The Service is provided "as is" without any warranties regarding availability, reliability, or fitness for a particular purpose.
By participating in beta testing, you acknowledge and accept these conditions.
4. Modifications to These Terms
We may modify these Terms of Service at any time by posting a revised version on the Service. Material changes will be communicated via email or a notice within the Service. The revised Terms of Service become effective upon posting, unless we state otherwise. Your continued use of the Service after changes are posted constitutes your acceptance of the revised Terms.
5. Term, Termination, and Suspension
5.1 Term
This Agreement begins when you create an Account and continues until terminated by you or by us.
5.2 Termination by You
You may terminate this Agreement at any time by:
- Closing your Account through account settings on the Service, or
- Contacting us at support@thestreamhand.com to request Account closure.
Upon termination, your streaming configurations, output destinations, stream keys, and any uploaded fallback media will be deleted from our systems.
5.3 Termination or Suspension by Us
We may suspend or terminate your Account:
- Immediately if you violate these Terms, engage in fraudulent activity, attempt to disrupt the Service, or use the Service for illegal purposes.
- Immediately if you are in default of any payment obligation.
- With 30 days' notice for any other reason or no reason.
5.4 Effect of Termination
Upon termination:
- You remain liable for all fees incurred through the date of termination.
- All rights and licenses granted to you under this Agreement terminate immediately.
- Your stored data (streaming configurations, fallback media, account data) will be deleted within 30 days, unless we are required to retain certain information by law.
5.5 Refunds
No refunds of prepaid fees will be issued upon voluntary Account closure, except where:
- Streamhand has experienced a service outage preventing you from using the Service for at least 72 consecutive hours, or
- A technical issue with the Service has remained unresolved for 7 days after you reported it to us.
6. License Grant
Subject to your compliance with this Agreement and applicable payment terms, we grant you a limited, non-exclusive, non-transferable, non-sublicensable, revocable license to access and use the Service during the Term. This license includes the right to use the Streamhand mobile app on your personal devices.
We reserve all rights not expressly granted in this Agreement. You do not acquire any ownership interest in the Service or any related intellectual property.
7. Acceptable Use
7.1 Your Content
"Your Content" means any data, media, stream content, fallback images or video, and other materials that you upload, stream, or otherwise provide through the Service. You are solely responsible for Your Content.
7.2 You May Not:
- Stream content that is illegal, promotes illegal activities, or violates the rights of others.
- Stream content that is defamatory, harassing, threatening, or discriminatory based on race, sex, religion, nationality, disability, sexual orientation, or age.
- Stream content depicting explicit sexual activities or extreme violence intended solely for entertainment.
- Use the Service to infringe or misappropriate any third party's intellectual property rights.
- Interfere with or attempt to disrupt the functionality of the Service, including denial-of-service attacks.
- Attempt to gain unauthorized access to the Service, other users' accounts, or our infrastructure.
- Reverse engineer, decompile, or disassemble any part of the Service.
- Resell, sublicense, or redistribute the Service or access to the Service without our prior written consent.
- Use the Service in any manner that violates applicable law.
7.3 Enforcement
We reserve the right to remove any content and suspend or terminate any Account that violates this Acceptable Use Policy, at our sole discretion and without prior notice.
8. Downtime and Service Availability
You acknowledge that:
- The Service may experience downtime due to maintenance, updates, power outages, system failures, or other interruptions.
- We may suspend access to the Service for scheduled maintenance, security incidents, denial-of-service attacks, or if required by law.
We will endeavor to provide advance notice of scheduled maintenance where possible. We have no liability for any damage, data loss, or consequences resulting from service downtime or suspensions.
9. Fees and Payment
9.1 Service Fees
If you subscribe to a Paid Service, you agree to pay the fees described on the Service's pricing page. We may change fees for existing services or begin charging for previously free features with 30 days' advance notice.
All fees are exclusive of applicable taxes. You are responsible for any applicable sales tax, VAT, or other taxes.
9.2 Payment Processing
Payments are processed by Stripe. By subscribing to a Paid Service, you agree to Stripe's terms of service. Streamhand does not directly store your full payment card information.
9.3 Billing
Paid Services are billed on a recurring basis (monthly or annually, as selected by you). Your subscription will automatically renew at the end of each billing period unless you cancel before the renewal date.
10. Intellectual Property
10.1 Our Property
We retain all rights, title, and interest in and to the Service, including all software, designs, trademarks, and other intellectual property. Nothing in this Agreement grants you any ownership interest in the Service.
10.2 Your Content
You retain all rights to Your Content. By uploading content to the Service (such as fallback media), you grant us a limited license to store, transmit, and display that content solely as necessary to provide the Service to you. This license terminates when you delete the content or close your Account.
10.3 Feedback
If you provide suggestions, ideas, or other feedback about the Service ("Feedback"), you grant us an unrestricted, irrevocable, royalty-free license to use that Feedback for any purpose without obligation to you.
11. Third-Party Services and Platforms
11.1 Streaming Destinations
Streamhand forwards your stream to third-party platforms (such as YouTube, Twitch, Facebook, and others) that you configure as output destinations. Your use of those platforms is governed by their own terms of service and privacy policies. Streamhand is not responsible for the actions, content policies, or availability of third-party platforms.
11.2 Meta Wearables Device Access Toolkit
The Streamhand mobile app integrates with Meta's Wearables Device Access Toolkit (WDAT) to connect with Meta AI glasses. Your use of Meta AI glasses and the WDAT is governed by Meta's terms and policies. Streamhand is not responsible for the availability, functionality, or data practices of Meta's SDK or hardware.
11.3 App Stores
The Streamhand mobile app is distributed through Apple's App Store (via TestFlight) and Google Play. Your download and use of the app is also subject to the applicable app store's terms of service.
12. Disclaimers
The Service is provided on an "as is" and "as available" basis, without any warranties of any kind, either express or implied. Streamhand does not warrant that the Service will be uninterrupted, error-free, secure, or free of viruses or other harmful components.
To the fullest extent permitted by law, Streamhand disclaims all warranties, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
Your use of the Service is at your own risk.
The foregoing does not affect any warranties that cannot be excluded or limited under applicable law.
13. Limitation of Liability
To the fullest extent permitted by law, Streamhand and its officers, members, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or exemplary damages, including but not limited to damages for loss of profits, goodwill, data, or other intangible losses, arising out of or in connection with your use of the Service.
In no event shall Streamhand's total aggregate liability under this Agreement exceed the amount you have paid to Streamhand in the twelve (12) months preceding the event giving rise to the claim, or one hundred dollars ($100), whichever is greater.
The limitation of liability set out above does not apply to liability resulting from our gross negligence or willful misconduct.
The foregoing does not affect any liability that cannot be excluded or limited under applicable law.
14. Indemnification
You agree to indemnify, defend, and hold harmless Streamhand and its officers, members, employees, and agents from and against any claims, losses, damages, liabilities, and expenses (including reasonable attorneys' fees) arising out of or relating to:
- Your use of the Service in violation of this Agreement or applicable law.
- Your Content, including any claim that Your Content infringes or misappropriates a third party's rights.
- Your violation of any third party's rights.
- Any streaming activity conducted through your Account.
15. Governing Law and Disputes
15.1 Governing Law
This Agreement shall be governed by and construed in accordance with the laws of the State of Washington, without regard to its conflict of law provisions.
15.2 Jurisdiction
Any legal action or proceeding arising out of this Agreement shall be brought exclusively in the state or federal courts located in King County, Washington. You consent to the jurisdiction of such courts and waive any objection to venue.
15.3 Limitation on Claims
Any cause of action or claim arising out of or relating to this Agreement must be commenced within one (1) year after the cause of action accrues; otherwise, such cause of action is permanently barred.
16. Notices
16.1 To You
Notices from us to you will be sent to the email address associated with your Account, or posted on the Service. You are responsible for keeping your email address current. You are deemed to have received any email sent to your registered email address upon our sending of the email.

17. General Provisions
17.1 Severability
If any provision of this Agreement is held to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.
17.2 Waiver
Our failure to enforce any provision of this Agreement shall not constitute a waiver of that provision or any other provision.
17.3 Entire Agreement
This Agreement, together with the Privacy Policy, constitutes the entire agreement between you and Streamhand regarding the Service and supersedes any prior agreements.
17.4 Assignment
You may not assign or transfer this Agreement or your rights under it without our prior written consent. We may assign this Agreement without restriction.
17.5 No Agency
Nothing in this Agreement creates any partnership, joint venture, employment, or agency relationship between you and Streamhand.
